What happens in this scenrio?

what happens if your have uninsured car and your parked in front of your house.you live in town and its been sitting there for a month or so. you rent so you dont have a drive way. and a car hits your car backing out trying to get on the street and takes off without saying a word and then someone sees it has all the info. name of person, license plate # you call police. and they say that its not 1000 dollars in damage. he contacts the person and they denied everything then police told them there was witnesses and he fesses up. my question is what should i do the car is not insured but i wasnt driving he hit my car and took off.. who's fault would it be and would i get into trouble?
